Terms and Conditions

These Terms and Conditions (the “Terms”) describe the terms and conditions under which the Revenue Enhancement Committee (the “Committee”) of the Massachusetts Access to Justice Commission (the “Commission”) provides access to, and governs the use of, the website located at civillegalaid.info and its subdomains (collectively, the “Website”). Please read the Terms carefully. By accessing, browsing and/or using the Website, you, as a user of the Website (“you” or “your”), acknowledge that you have read, understood, and agree to be legally bound by the Terms. If you do not accept the Terms (and therefore do not agree to by bound by the Terms), do not access, browse, or use the Website. The Committee reserves the right to amend the Terms at any time by posting the amended terms on the Website.

Privacy Policy

The Privacy Policy describes how the Committee collects, uses, stores, and discloses the information that you submit in connection with your use of the Website. Please review the Privacy Policy carefully before using the Website. By using the Website, you consent to the Committee’s collection, use, and disclosure of your Personal Information in accordance with the Privacy Policy.

Eligibility

By using the Website, you represent and warrant that you (a) have not been previously suspended or removed from the Website or engaged in any activity that could result in suspension or removal from the Website, and (b) have full power and authority to agree to the Terms and in so doing will not violate any other agreement to which you are a party. The Website is not intended for use by individuals under the age of 13. By using the Website, you represent that you are 13 years of age or older and, if you are under the age of 18, you are either an emancipated minor or have obtained the legal consent of your parent or legal guardian to enter into the Terms.

You also acknowledge that the Content is and shall remain the property of the Committee. You shall at no time assert any claims of ownership over any of the Content by reason of your use of or any right to use the Website and shall not grant or create or suffer to exist any lien or other security interest arising therefrom. You agree to comply with all copyright and trademark laws, and you shall not encumber any interest in, or assert any right to, the Content. You may not modify, transmit, participate in the sale or transfer of, or create derivative works based on any Content, in whole or in part. The Committee authorizes you to view and use the Content on the Website solely for your informational and noncommercial use. You may print copies of the Content, provided that such copies are made only for informational and non-commercial use and that you maintain any notices and disclaimers contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. You shall not store electronically any significant portion of any of the Content. The use of the Content on any other site, including by linking or framing, is prohibited without the prior written approval of the Committee.

Moreover, “the Civil Legal Aid Directory,” “MassA2J,” and all related names, logos, product and service names, designs and slogans are trademarks or service marks of the Committee or the Commission. All other names, logos, product and service names, designs and slogans on the Website are the trademarks or service marks of their respective owners. You may not use or display any Committee or Commission trademarks, trade names, or logos without the prior written permission of the Committee or the Commission, as applicable. Each reserves all rights.

The Committee is Not Responsible for Third-Party Content

The Website may contain links to third-party websites, products, services, and may redirect you to third party applications (each, a “Linked Third-Party Service”). The Committee is not responsible for the content of any Linked Third-Party Service. When you access and use a Linked Third-Party Service, you are subject to that third party’s terms and conditions and privacy policy, and you agree that the Committee is not responsible for such content, terms and conditions, and privacy policy. Inclusion of a Linked Third-Party Service shall not be interpreted as constituting or implying the Committee’s or the Commission’s endorsement or recommendation of the information or the views expressed therein.

Prohibited Conduct

You may use the Website only for lawful purposes and in accordance with the Terms. You agree not to, and you shall not use the Website:

  • In any way that violates any applicable federal, state or local law or regulation.
  • For the purpose of exploiting, harming, threatening, harassing, or defaming any person, or attempting to do any of the foregoing.
  • In a way that violates any other individual’s right to privacy.

  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website.
  • Otherwise attempt to interfere with the proper working of the Website.

In addition to any other rights the Committee or Commission may have or remedies each may pursue, the Committee may deny your access to and use of the Website if the Committee believes, in the Committee’s sole and unfettered discretion, that you have engaged in any activity prohibited under the Terms.

THE WEBSITE AND THE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR INFORMATIONAL AND NONCOMMERCIAL PURPOSES ONLY. NEITHER THE COMMITTEE NOR ANY OF ITS AFFILIATES OR ANY OF ITS OR THEIR RESPECTIVE OFFICERS, DIRECTORS, VOLUNTEERS, EMPLOYEES, AGENTS, REPRESENTATIVES, ADVISORS, CONTRACTORS, AND CONSULTANTS (COLLECTIVELY, “COMMITTEE PARTIES”) MAKE ANY REPRESENTATIONS, ENDORSEMENTS, GUARANTEES OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE WEBSITE OR ANY OF THE CONTENT, INCLUDING (1) ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, CURRENCY, OR TIMELINESS OF THE CONTENT, SOFTWARE, FUNCTIONALITY, TEXT, GRAPHICS, LINKS, OR COMMUNICATIONS PROVIDED ON OR THROUGH THE USE OF THE WEBSITE OR CONTENT; (2) THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR FREE; OR (3) THAT THE WEBSITE, ITS SERVER, OR ANY FILES AVAILABLE FOR DOWNLOADING THROUGH THE WEBSITE ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL ELEMENTS.   • TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU UNDERSTAND AND AGREE THAT YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE WEBSITE, THE CONTENT, OR ANY LINKED THIRD-PARTY SERVICE IS TO STOP YOUR USE OF IT.

Indemnification

You will indemnify, defend, and hold harmless the Committee and the Committee Parties from and against any and all claims, causes of action, demands, liabilities, losses, costs or expenses (including, reasonable attorneys’ fees and expenses) arising out of or relating to your access to or use of the Website or the Content.

Termination

The Committee reserves the right, in its sole and unfettered discretion, to restrict, suspend, or terminate the Terms and your access to all or any part of the Website or the Content, at any time and for any reason without prior notice or liability. The Committee reserves the right to change, suspend, or discontinue all or any part of the Website or the Content at any time without prior notice or liability.

Governing Law

You and the Committee agree that the Terms and any dispute between you and the Committee relating to your use of the Website or the Content shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law provisions. Any action relating to the Content, Website, Privacy Policy, or Terms shall be brought in the federal or state courts located in Massachusetts, and you hereby irrevocably consent to the jurisdiction and venue of such courts.

Any cause of action you may have with respect to the Content, Website, or the Terms must be commenced within one (1) year after the claim or cause of action arose or it shall be barred.

Severability

In the event that any portion of the Terms is held to be invalid or unenforceable, the invalid or unenforceable portion shall be construed in accordance with the applicable law as nearly as possible to reflect the original intentions of the Terms, and the remainder of the Terms shall remain in full force and effect.

Miscellaneous

The Terms contain the entire agreement between you and the Committee regarding the Website and supersede any and all oral, written, or other communication concerning its subject matter. Except as described in the section titled Changes to the Terms, the Terms may not be amended except in writing by the Committee.

The paragraph headings herein are provided only for reference and shall have no effect on the construction or interpretation of the Terms. The Committee’s failure to enforce your strict performance of any provision of the Terms shall not constitute a waiver of the Committee’s right to subsequently enforce such provision or any other provision of the Terms. Neither the course of conduct between parties nor customary practice shall act to modify any provision of the Terms.

You agree that the Committee may send you notice via email to the email address you have provided to us, and the Committee is not responsible for your failure to receive notice if the email is quarantined by your email security system (e.g., “junk” or “spam” folder) or if you fail to update your email address.

Changes to the Terms

The Committee reserves the right to change or otherwise modify these Terms at any time. All changes are effective immediately when the Committee posts them and apply to all access to and use of the Website thereafter. The Committee may also notify you by sending an email notification or alerting you to the changes when you visit the Website. Your continued access or use of the Website after receiving notice of any the update, modification or other change to the Terms signifies your acceptance thereof.
